    Without incriminating anyone...

    Anyone ever have a citizen (not an officer) file a citizens complaint against them for their driving? Officer writing the complaint, different from a citation, was quick to say that the offending infraction wasn't done in their presence, but something I am to face a judge against the other person. Sounds like it coils down to a he said vs. he said scenario. Must have confused me for someone else with an old orange 911...
    This is new territory for me. I'm used to getting tickets the traditional way, by a lidar gun However, I fully intend to fight a hearsay type battle. Any advise out there?

    obviously they (citizen filing complaint) are targeting you for having a nice sports car.

    You have to see a judge because someone filed a complaint?

    This smacks of schoolyard tattle tale nonsense.

    I wouldnt worry about fines or anything - there's no proof. It's just going to be an absurd waste of government judicial resources and your time.

    What jurisdiction are we talking about? What you are describing is an artifact in the common law that I hazard to suggest few lawyers know about.

    If it helps, I'll get a notarized letter stating you are an upstanding citizen and that I've never had any problems with the way you drive.

    This sounds like a so-called "citizens arrest," which based on my experience in CA (when I was rear-ended by a unlicensed driver) is not encouraged by law-enforcement authorities., probably because 1. the see it as THEIR job to enforce laws, and 2. they may seldom result in a conviction) You must have P O'd someone. It will be "he said, she said." However, I've not idea as the legal precedence, etc. involved. However, I'd guess you have a very good chance of winning BUT you might want to get a lawyer. What was the "infraction?" Thanks.

    Sooo. Even Paul Harvey used to "Now for the rest of the story". I know, I know. It was your evial twin brother out on a pre-purchese test drive. Which was the case once for me. I stood acused oif some really awsome burn outs in my 401 powered 70 1/2 AMX. My car, looked like my M50x15 tire tracks. I thought they may be a little long. Then started talking it over with the Police Officer. It wasen't Me. I was outa town on my honeymoon, and I had the papper to prove it. A speeding ticket in the 530i over 300 miles away. Ah yes Virgina Beach or was it Virgina is for Lovers. Who had my AMX? I really didn't care and thats my story. But Oh yea I did collect for a new set of rear skins for keeping the secreat. Now if one were to pull well planed move a cargo van full of Sunday worshipers while out an a spireted afternoon drive, Hell it still might all work out in your favor. unless the Judge drives a Pontiac. Here comes the Judge, with it's RAM AIR IV. God I hate tattletails.

    Quite an amazing parallel to an experience I had some years ago with my Tangerine '73 hotrod, large power, short, short gears and a very, very noisy B&B muffler. I blasted up the Mountain Road winding it out to redline again and again going quite fast. I pulled over a mile up the road and got out to review an antique barn I was to dismantle. Five minutes into it one of Stowe's finest officers pulled up and asked if I had just come up the road. "Perhaps" says I. He had a complaint called in that described the perp as driving a bright orange Porsh and going like hell. "Maybe" says the perp, "I live right here." Stowe's finest became convinced by the perp that there were no real witnesses, he saw nothing himself, and since I admitted nothing there really was no infraction at all. He knew the perp was right, but still wrote me up with a warning. Funny as hell. It was a quiet stretch of straight road with no driveways and little risk to anyone. I didn't even get it up to 115. Honest. [wink]
